1. What is the McCloud Remedy?

The McCloud Remedy is the government's solution to remove age discrimination from public sector pension reforms that took place in 2014-2015. It's named after Lord Justice McCloud, who chaired the Court of Appeal that ruled the reforms were discriminatory.

The Core Principle

You get the better deal. For service between 1 April 2015 and 31 March 2022, eligible members can choose between their legacy scheme benefits and the reformed scheme benefits - whichever is more valuable.

Why is this Important?

  • Financial impact: Could add thousands of pounds to your pension value
  • Automatic protection: You don't need to apply - it should be calculated automatically
  • Complexity: The calculations are complex and errors are common
  • Time sensitive: Implementation is ongoing, but mistakes need early detection

2. Background & Court Case

2010-2014: Pension Reforms Announced

Government announces major public sector pension reforms to reduce costs

2014-2015: Reforms Implemented

New pension schemes introduced with "transitional protections" for older workers

2018: Court of Appeal Ruling

Court rules that transitional protections constitute unlawful age discrimination

2021-2023: Remedy Legislation

Government passes laws to implement the McCloud Remedy across all affected schemes

2024-2026: Implementation

Pension schemes implement remedy - ongoing process with many challenges

The Discrimination Problem

When pension reforms were introduced, older workers (typically those within 10 years of retirement) were given "transitional protection" - they could stay in their original, more generous pension schemes.

Younger workers had to move to the new, less generous schemes. The courts ruled this was unlawful age discrimination, as identical service was being treated differently based solely on the worker's age.

3. Who is Affected?

You are likely affected by the McCloud Remedy if you meet these criteria:

Not Sure if You're Affected?

Even if you're not certain about your eligibility, it's worth checking. The McCloud Remedy is complex, and many people who think they're not affected actually are. Professional analysis can clarify your position definitively.

4. How the Remedy Works

The remedy gives eligible members a choice for their service during the "remedy period" (1 April 2015 to 31 March 2022). You can choose between:

Option 1: Legacy Scheme Benefits

  • • Usually final salary based
  • • Often more generous accrual rates
  • • Higher lump sums in some schemes
  • • Earlier normal retirement ages
  • • May include additional protections

Option 2: Reformed Scheme Benefits

  • • Career average revalued earnings (CARE)
  • • More predictable benefits
  • • Better inflation protection in some cases
  • • Flexible retirement options
  • • Lower member contribution rates (sometimes)

The "Better Deal" Principle

The pension scheme should automatically calculate your benefits under both sets of rules and give you the higher amount. This is called the "underpin" - ensuring you get at least as much as you would have under the reformed scheme, but potentially more under the legacy scheme.

You don't need to make an active choice in most cases - the scheme will give you the better deal automatically.

Key Calculation Points

  • 1.

    Service Splitting

Your service is split into three periods: pre-2015 (legacy rules), 2015-2022 (choice), post-2022 (reformed rules)

  • 2.

    Dual Calculations

Benefits for 2015-2022 calculated under both legacy and reformed scheme rules

  • 3.

    Comparison & Selection

The higher value is selected and combined with your other service

  • 4.

    Tax Adjustments

Any additional benefits may trigger pension tax charges that need to be managed

5. Scheme-Specific Details

While the principles are the same, each scheme has its own implementation details:

6. Common Calculation Errors

McCloud calculations are extremely complex, and errors are unfortunately common. Here are the most frequent issues we find:

1. Incorrect Member Identification

The Problem: Schemes incorrectly identify who is eligible for the remedy.

Some members who should benefit are excluded, while others who shouldn't benefit are included. This often happens due to incomplete service history data.

2. Service Period Errors

The Problem: Incorrect dates used for the remedy period or missing service.

The remedy period is exactly 1 April 2015 to 31 March 2022. Any service outside this period should not be subject to choice, but we often see incorrect period splitting.

3. Wrong Calculation Factors

The Problem: Using incorrect accrual rates, retirement ages, or other scheme-specific factors.

Each scheme has detailed technical specifications for the remedy. Administrators sometimes use the wrong factors, particularly for complex cases like part-time service or career breaks.

4. Data Quality Issues

The Problem: Poor quality historical data leads to incorrect calculations.

Legacy scheme calculations require historical salary data that may be incomplete or inaccurate. This is particularly problematic for members with complex employment histories.

5. Tax Calculation Errors

The Problem: Failing to properly account for pension tax implications.

Additional benefits from the remedy may trigger annual allowance or lifetime allowance charges. These need to be calculated correctly to determine the true net benefit.

7. What Should You Do?

If You Haven't Retired Yet
